Sacramento Bicycle Accident Attorneys

Cycling accidents are unfortunately common occurrences that are almost always preventable. Sacramento bicycle accidents involving motor vehicles, trucks, motorcycles or pedestrians all have the potential to result in serious or fatal injury. If you have been injured by a careless, negligent or distracted driver, you are entitled to be compensated for your injuries. An experienced attorney familiar with bicycle accidents can help you protect your legal rights following an accident and obtain justice by recovering full and fair compensation.

California Bicycle Accident Case Experience

Many members of the Estey & Bomberger professional staff are avid cyclists, including founding partner Mike Bomberger. Attorney Bomberger has represented many cyclists injured by careless motorists, negligent bicycle manufacturers and repair shops, and by poorly maintained roads. As cyclists, we are uniquely aware of the heightened risks that cyclists face and the dangers of sharing the road with other vehicles.  Our attorneys have successfully obtained large verdicts and settlements for victims of bicycle accidents – see our case results.

Bicycle Accidents and Injuries

Bicyclists are not protected by safety features such as airbags, seat belts, anti-lock breaks, and stability control systems that protect drivers and passengers in cars. Even with a helmet, bicyclists are much more likely to be seriously injured in an accident than an automobile occupant. Common bicycle accident injuries in collisions with automobiles, trucks and motorcycles include:

Bicycle Accidents and Children

For children ages 8 through 14, bicycle accidents and pedestrian accidents are the leading cause of death. The California Department of Motor Vehicles estimates that about 28% of bicycle accident victims are children under the age of 15. In California, under Section 21212(A) of the California Vehicle Code, children under 18 years old are required to wear a properly fitting and fastened bicycle helmet that meets the standards of either the America Society for Testing and Materials (ASTM) or the U.S. Consumer Product Safety Commission (CPSC).

California Cycling Laws

In California, bicycles are legally considered to be vehicles, and are not considered pedestrians. Bicyclists must follow most of the same traffic laws and have the same rights to share the road as automobiles and motorcycles. This includes stopping at stop signs and red lights at intersections, riding along with the flow of traffic, yielding to the right-of-way, using lights at night, and not cycling under the influence of alcohol.

Bicycle Accidents and Head Injuries

Head injuries are one of the most common and most devastating injuries a cyclist can suffer. One in eight injury bicycle accidents results in a traumatic brain injury. In California, the CHP reports that 87% of bicyclists killed in accidents were not wearing a helmet. While helmets improve a cyclist’s chances of surviving a serious bicycle accident, they do nothing to prevent an accident from occurring. For this reason, it is important that all cyclists, especially children, understand their responsibilities when riding a bicycle on Sacramento streets.

Bicycle Accident Injury Compensation

If a negligent automobile driver has caused serious injury to you or a loved one, you may be entitled to financial compensation from the responsible party. The long recovery an injured cyclist may face may cause financial hardship. An experienced bicycle accident attorney can help you obtain the damages you are entitled to for your injuries, medical expenses, time away from work, and pain and suffering.
